CURBSQUARE TERMS OF SERVICE

This is an agreement between You and Addressgate Inc. operator of Curbsquare.com (“Curbsquare”, “Addressgate”, “Us” or “We”). The services that Curbsquare provides to You are subject to the following Terms of Service (“TOS”). You must agree to comply with all the terms and conditions of this TOS to use CURBSQUARE.COM (“the Service”). Opening an account on Curbsquare.com indicates acceptance of all terms and conditions of this TOS. Curbsquare reserves the right to update the TOS at any time without notice to you.

To open an account on Curbsquare.com and use the Service you must:

Be at least 13 years of age.
Be a resident of the United States.
Claim a street address at which you are physically able and legally authorized to receive US postal mail. You must be either the property owner, the principal resident, the principal lessee, or have written permission to claim the street address on the Service on behalf of the owner or resident of the property at the claimed street address. In case of conflicts the person who receives postal mail at the claimed street address will control the account.
Provide a valid email address you are authorized to use and a password.
Comply with all applicable laws and not start or participate in any illegal or harmful activities using the Service.
Notify us immediately if there is a security breach, illegal activity on the Service or a violation of the TOS.
Not access the Service using an automated or a manual process to capture data or content from the Service for any reason and/or to damage, disable, slow-down, overload or otherwise attack the Service.
Not click on your ISP's or mail client's SPAM, Abuse or Complaint buttons in response to a Curbsquare service email. Gracefully Unsubscribe, or Delete your account instead.

We hate SPAM and have made every effort to place You in complete control of every message we send You. Every email we send has one or more prominently marked one-click Unsubscribe links for You to use. If You ever feel a Curbsquare message is SPAM we ask that You (1) take advantage of your account's Notification Settings, (2) click the Unsubscribe link at the top of all Curbsquare emails, or (3) Delete your account. We don't want to send You email messages you don't find valuable and we didn't create Curbsquare to bother You or anyone else. But please, do not casually click on your ISP's or mail client's SPAM, Abuse or Complaint buttons. This action can't be undone by us and will permanently lock you out of your Curbsquare account.

You are responsible for maintaining control and the security of the email address and password you use to sign up to the Service. Failure to maintain security and control of your email account may result in loss of access to your Curbsquare.com account and loss of all personal communications, information, and data stored on the Service. We are not responsible for such losses.

CONTENT ON THE SERVICE

You can post content that you create and own the rights to, or have the owners permission to post, is legal and doesn’t violate our TOS. You agree not to post anything that contains explicit or graphic descriptions of sexual acts, violence, or that may be damaging to others in any way. You are solely responsible for the content you post to the Service and assume any and all risks of posting personal data or information.

You retain ownership of all rights, title, and interests to all content you post on the Service but grant Curbsquare and our assigns, agents, and licensees the irrevocable, royalty free, non-exclusive, worldwide license to use, reproduce, process, copy, publish, modify, adapt, transmit, redistribute, display, promote, sub-license and syndicate the content in any media and method of distribution available now or in the future.

You may view and print portions of web pages displayed by the Service for personal non-commercial purposes but you may not modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained using the Service. In the case of downloadable binary data such as software and graphic images, you may download such material for use as instructed but you may not edit or attempt to decompile or reverse engineer in any way.

Limited permission to use white papers, press releases, data sheets and FAQs (“Documents”) is granted, provided that (1) the Curbsquare copyright notice appears in all copies, and (2) such use is for informational and non-commercial or personal use only and will not be copied or posted on any network computer, and (3) no modifications are made. Accredited educational organizations may download and reproduce the Documents for distribution in the classroom. Distribution outside the classroom requires express written permission of Curbsquare.

You are responsible for all charges and fees needed to access the Service, including telephone and Internet access fees, text message fees and any wireless carrier charges.

PAID SERVICES

If you purchase one of Curbsquare.com’s paid services You agree to provide Us with accurate and valid billing and credit card information and to pay all charges and fees when due. All charges are non-refundable. You must notify us of any discrepancies or billing issues within (90) after they appear on your statement. If you don’t tell us within the 90 day time period you waive your right to dispute any discrepancies or billing issues. You can cancel a paid service by calling, faxing fax, or mailing us a letter.

ADVERTISING

In order to support the operation of Curbsquare.com’s free service, we can place advertising within applications, web pages, mobile devices and postal mailings.

DISCLAIMERS AND WARRANTIES

THE SERVICE AND ALL ITS CONTENT IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. YOUR USE OF OR RELIANCE ON ANY CONTENT IS TO BE UNDERTAKEN AT YOUR OWN RISK. WE HAVE NO LIABILITY TO YOU FOR CONSEQUENCES OF USING OR RELYING ON THE SERVICE. Curbsquare makes no warranty, expressed or implied, with respect to its content or any documents linked or referenced within, including (but not limited to) implied warranties of merchantability and fitness for a particular purpose.

While every effort has been made to find and correct errors in web pages related to or generated by the Service, Curbsquare assumes no responsibility for errors or omissions in this website or any documents linked or referenced.

The Service may contain factual and typographical errors. Curbsquare reserves the right to make corrections, additions and deletions to the material presented at any time without notice. Curbsquare may also make improvements and or changes at any time without obligation to give notice of such changes.

References to sources outside this website are hereby provided “AS IS” without warranty of any kind and for information or entertainment purposes only.

In no event shall Curbsquare or its developers, directors, officers, employees or affiliates be liable to you for any indirect, special, incidental, or consequential damages (including damages for loss of business profits or goodwill, business interruption or loss of business information), whether foreseeable or not, arising out of the use or inability to use the information or products presented.

FEEDBACK NOT CONFIDENTIAL

All information and feedback sent to us regarding the content of this Website, the Service or any Curbsquare products shall be deemed as NOT CONFIDENTIAL and Curbsquare will be free to use and distribute this feedback to others without limitation. By using the Service you agree that Curbsquare will be free to use any ideas, concepts and/or techniques disclosed in your communications with us for any purpose including incorporating such ideas, concepts and/or techniques in its products.

U.S. GOVERNMENT RESTRICTED RIGHTS

Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19, as applicable.

Curbsquare respects the intellectual property of others, and we ask users of our Service to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, subscribers or account holders who are deemed to be repeat infringers. We may also at our sole discretion remove Content alleged to be infringing without prior notice and at our sole discretion and limit access to our Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

GENERAL LEGAL TERMS

You agree to be bound by the laws of the State of Florida, USA. Any claims arising in connection with the Service will be brought solely in Miami-Dade County, Florida, and you agree to the jurisdiction of and venue of Miami-Dade courts and waive any objections of inconvenience.
